A barrister from 1849, Day became a judge in 1882. He decided that 'he would do most good by devoting his main energies to enforcing the moral law'. The readiness with which he resorted to the severest punishments, including lashes, earned him a fearsome reputation and the nickname 'Judgment Day'.
