Edward Kay trained in the law, becoming a barrister in 1847. He was made a Queen's Counsel in 1866 and a bencher at Lincoln's Inn the following year. In 1881 Kay was appointed Justice of the Chancery Division of the High Court, and in 1890 was promoted to Lord Justice of Appeal.
